These Terms of Service govern your access to and use of the Markly platform. By accessing or using Markly, you agree to these terms.

Markly is currently offered in a pilot phase. Features and plans may change as the product evolves.

Service description

Markly provides booking, scheduling, customer management, staff management, calendar synchronization, optional AI assistance, and related business-management tools.

Accounts and eligibility

You must provide accurate information and are responsible for activity under your account and for keeping your credentials secure. Markly is intended for business use.

Business owner responsibilities

  • You are responsible for the customer and staff data you collect and enter into Markly.
  • You are responsible for obtaining any consents required from your customers and staff.
  • You are responsible for the accuracy of your services, pricing, availability, and policies.
  • You are responsible for ensuring you have a lawful basis for any communications you send.

Acceptable use

You agree to use Markly lawfully and only for its intended business purposes.

Prohibited use

  • Illegal activity or content that infringes the rights of others.
  • Spam or unsolicited messaging.
  • Collecting special-category or highly sensitive personal data without a lawful basis.
  • Attempting to breach security or to access another business's data.
  • Scraping, overloading, or interfering with the platform.

AI limitations

AI features may produce inaccurate or incomplete output. AI responses are informational only and are not professional, legal, medical, or financial advice. Review AI output before relying on it.

Calendar integration limitations

Calendar synchronization depends on third-party providers such as Google and Microsoft. Availability and sync are not guaranteed. By connecting a calendar, you authorize Markly to read availability and create or update events for appointments.

Service availability

Markly is provided on an as-is and as-available basis. During the pilot phase there may be interruptions, and we do not provide an uptime guarantee.

Subscriptions and plans

Markly offers Free, Pro, and AI Premium tiers with different features and limits. Paid billing is being introduced; specific payment, renewal, and cancellation terms will be presented at the time paid billing is activated for your account.

Intellectual property

The Markly platform, software, and related intellectual property belong to Markly. You retain rights to the content you provide, and you grant Markly the rights needed to operate the service for you.

Termination

We may suspend or terminate access for violations of these terms or to protect the platform. You may stop using Markly at any time.

Limitation of liability

To the maximum extent permitted by law, Markly is not liable for indirect, incidental, or consequential damages, and our aggregate liability is limited to the amounts paid for the service, if any.

Support

Support is provided on a reasonable-effort basis at imark3020@gmail.com. During the pilot phase we do not guarantee response times.

Pilot notice

Markly is evolving. Features, plans, and data structures may change during the pilot phase.

Changes to these terms

We may update these terms as the product evolves and will update the date above. Continued use after changes constitutes acceptance.
